Definitions & Parties

  • “Artist” refers to Kat Bak Creative.

  • “Buyer”, “you” refers to the person purchasing from Kat Bak Creative.

  • “Artwork” refers to original hand-drawn pieces, prints, or commissions sold via this site.

Orders & Payment

  • Full payment is required before an order is processed.

  • All prices are in Australian Dollars (AUD).

  • Once payment is received in full, ownership of the Artwork transfers to the Buyer.

Delivery / Shipping

  • Original artwork is dispatched and carefully wrapped within 3–5 business days (unless communicated otherwise).

  • Shipping costs are calculated at checkout.

  • Risk of loss or damage passes to the Buyer once the Artwork is dispatched.

  • For framed products, frames may be shipped separately due to limited studio space.

Returns & Damaged Goods

  • If the Artwork arrives damaged or incorrect, please email Kat Bak (with photos) within 48 hours of delivery.

  • Your order will either be replaced or issued a refund for damaged or incorrect orders.

  • Change-of-mind returns are not accepted for original artworks.

Copyright & Intellectual Property

  • Copyright in all Artwork remains with Kat Bak.

  • Purchasing a piece does not grant you the rights to reproduce, modify, or use the Artwork for commercial purposes unless explicitly agreed in writing.

  • All moral rights are retained (e.g., attribution).

Resale Royalty

  • Under Australian law, resale royalty rights may apply if the Artwork is resold in a qualifying commercial art market. See the Visual Arts Resale Royalty for more information. (NAVA)

  • By purchasing, you acknowledge and agree to respect these resale royalty provisions.

Colour / Material Variation

  • Due to natural variation in timber (for frames) and differences in screen settings, actual colours may vary slightly from what is displayed online.

  • Paper tone and ink may also vary from digital images.

Limitation of Liability

  • To the fullest extent permitted by law, our liability is limited to the purchase price of the Artwork.

  • Kat Bak is not liable for indirect or consequential losses.

Dispute Resolution

  • If a dispute arises, please contact the artist directly, and Kat Bak will attempt to resolve the issue in good faith.

  • These Terms are governed by the laws of Victoria, Australia.

Changes to These Terms

  • Kat Bak reserve the right to update or modify these Terms at any time.

  • Any changes will be posted on this page. Continued use / purchase from the site constitutes your acceptance of the updated Terms.

Commissions

  • For commissioned works, specifics (size, medium, deadlines, rights) will be agreed in writing (e.g., via email) prior to commencement.

  • A non-refundable deposit may be required for commissions — to be agreed case-by-case.

  • Copyright for commissioned Artwork remains with Kat Bak unless otherwise agreed.
